2. THREE-DAY FREE TRIAL
2.1 Trial Eligibility
Eligible new subscribers may receive a three-day free trial of the selected subscription plan.
A valid payment method is required to activate the trial.
2.2 Trial Duration
The free trial begins when the subscription is successfully activated and continues for three consecutive 24-hour periods.
The exact trial expiration date and time will be disclosed during checkout or within the subscriber's account.
2.3 Automatic Conversion to Paid Subscription
Unless canceled before the trial expires, the subscription will automatically convert to a paid subscription.
The payment method on file will be charged the applicable monthly or annual subscription fee according to the plan selected during registration.
By activating a free trial, you expressly authorize Behavior Plan Pro to charge your selected payment method when the trial ends and for subsequent recurring subscription periods unless you cancel.
The subscription price, billing frequency, first payment date, and cancellation terms will be disclosed before payment authorization.
2.4 Canceling During the Trial
Subscribers may cancel at any time before the trial expiration date.
If cancellation is completed before the trial ends:
- No initial subscription fee will be charged.
- The subscription will not convert to a paid plan.
- No cancellation fee will apply.
Trial access will end when the trial expires unless otherwise disclosed.
2.5 Trial Limitations
Unless otherwise expressly offered, the free trial is available once per eligible Customer or Organization.
Behavior Plan Pro reserves the right to restrict repeated trial registrations or misuse of promotional offers.
3. SUBSCRIPTION BILLING AND AUTOMATIC RENEWAL
3.1 Billing Frequency
Behavior Plan Pro offers monthly and annual subscription options.
Subscription fees are charged according to the selected billing frequency.
3.2 Automatic Renewal
Subscriptions automatically renew at the end of each billing period unless canceled before the next renewal date.
By subscribing, the Customer authorizes recurring charges to the payment method on file.
3.3 Billing Authorization
The Customer is responsible for maintaining accurate and current payment information.
Recurring charges will continue until the subscription is canceled or otherwise terminated.
3.4 Subscription Pricing
Applicable subscription prices, included seats, location allowances, and additional charges will be disclosed during checkout or in an applicable written subscription order.
3.5 Price Changes
Behavior Plan Pro will provide at least 30 days' advance notice of increases to recurring subscription prices.
Price changes will apply prospectively and will not alter completed billing periods.
4. CANCELLATION POLICY
4.1 Cancel Anytime
Customers may cancel their subscriptions at any time.
There are no cancellation penalties or early termination fees for standard self-service subscription plans.
4.2 How to Cancel
An authorized account administrator may cancel by:
- Signing in to Behavior Plan Pro.
- Opening the Billing section.
- Selecting the cancellation option.
- Reviewing the cancellation details.
- Confirming the cancellation request.
Customers may also request assistance by emailing contact@behaviorplanpro.com.
Email cancellation requests are subject to reasonable verification of account authority.
4.3 Cancellation Deadline
To avoid the next recurring charge, cancellation must be completed before the next scheduled billing date and time.
Customers should verify the effective cancellation date displayed in their account.
4.4 Effective Date of Cancellation
For paid subscriptions, cancellation generally takes effect at the end of the current paid billing period.
The subscription will not renew after that period.
4.5 Access Following Cancellation
Customers who cancel a paid subscription will ordinarily retain access to their subscribed features through the end of the paid billing period.
After that date, access to paid features may be restricted or disabled.
4.6 Cancellation Confirmation
Behavior Plan Pro will provide a cancellation confirmation through the application or by email.
Customers should retain the confirmation for their records.
5. REFUND POLICY
5.1 General No-Refund Policy
Except where required by applicable law or expressly authorized by Behavior Plan Pro, subscription payments are nonrefundable.
Because eligible subscribers have an opportunity to evaluate the Service during a free trial, Customers are responsible for canceling before the applicable billing deadline if they do not wish to continue.
5.2 Nonrefundable Charges
The general no-refund policy applies to:
- Monthly subscription fees.
- Annual subscription fees.
- Partially used billing periods.
- Unused subscription time.
- Unused staff seats.
- Unused clinic locations.
- Subscription fees charged after an uncanceled trial.
- Subscription renewals that were properly disclosed and authorized.
5.3 Annual Subscriptions
Annual subscriptions are billed in advance for the selected annual term.
Canceling an annual subscription prevents the next annual renewal but does not ordinarily entitle the Customer to a refund of the remaining subscription period.
The Customer retains access through the end of the paid annual term unless access is otherwise suspended or terminated under the Terms of Service.
5.4 Exceptions
Refunds or billing adjustments may be issued when:
- Required by applicable law.
- A duplicate charge occurred.
- A billing error is confirmed.
- A charge was unauthorized.
- Behavior Plan Pro determines that a refund or credit is appropriate under the circumstances.
- A separate written agreement expressly provides for a refund.
Nothing in this Policy limits nonwaivable legal rights or remedies.
6. PLAN CHANGES, ADDITIONAL SEATS, AND LOCATIONS
6.1 Subscription Upgrades
Customers may upgrade their subscription plans where supported.
Additional charges, including applicable prorated amounts, will be disclosed before the upgrade is confirmed.
6.2 Subscription Downgrades
Downgrades may take effect immediately or at the next billing period, as disclosed when the change is requested.
Any applicable credits will be calculated according to the billing terms displayed at confirmation.
6.3 Additional Staff Seats
Customers may purchase additional staff seats where available under their subscription plan.
Additional seats may result in prorated or recurring charges.
6.4 Additional Locations
Eligible multi-location plans may permit the addition of clinic locations for an additional fee.
Applicable charges will be disclosed before confirmation.
6.5 Billing Credits
Where a plan change results in an account credit, the credit will generally be applied to future subscription charges.
Credits are not redeemable for cash unless otherwise required by law or expressly agreed in writing.
6.6 No Automatic Refund for Unused Capacity
Removing staff seats or clinic locations does not automatically entitle the Customer to a cash refund for previously paid subscription capacity.
7. FAILED PAYMENTS AND ACCOUNT SUSPENSION
7.1 Failed Transactions
If a scheduled payment fails, Behavior Plan Pro or its payment processor may attempt to process the payment again.
7.2 Payment Notifications
We may notify the account administrator of failed transactions and request updated payment information.
7.3 Suspension for Nonpayment
Continued nonpayment may result in restricted access, suspension, or termination of subscription services following reasonable notice.
7.4 Outstanding Balances
Cancellation does not eliminate valid charges incurred before the effective cancellation date.
7.5 Clinical Information Protection
Suspension for nonpayment does not eliminate Behavior Plan Pro's obligations to safeguard, return, or destroy PHI as required by the applicable Business Associate Agreement and law.
8. ACCOUNT ACCESS AND DATA AFTER CANCELLATION
8.1 Account Restrictions
After the subscription expires, the Customer's account may become inactive or restricted.
8.2 Customer Data
Behavior Plan Pro recognizes that clinical records may contain PHI and may be subject to legal retention requirements.
Customer Data will be handled according to the applicable:
8.3 Data Export
Authorized Customers may request an export of available clinic information.
Requests are subject to appropriate identity verification, security procedures, contractual requirements, and applicable law.
8.4 Data Deletion
Upon termination, PHI will be returned or destroyed as required by the applicable BAA.
Where return or destruction is infeasible, appropriate safeguards and restrictions will continue for as long as the information is retained.
8.5 Account Reactivation
Customers may reactivate subscriptions where supported.
Reactivation does not guarantee restoration of information that has already been lawfully deleted.
9. BILLING ERRORS AND DISPUTED CHARGES
9.1 Reporting a Billing Error
Customers who believe they were charged incorrectly should contact:
Customers are encouraged to report billing discrepancies within 30 days of the charge to facilitate prompt investigation.
This requested reporting period does not limit any longer period or remedy provided by applicable law or payment-network rules.
9.2 Investigation
Behavior Plan Pro will review reported billing discrepancies and may request relevant information to verify the transaction.
9.3 Confirmed Errors
If an incorrect charge is confirmed, Behavior Plan Pro will issue an appropriate correction, credit, or refund.
9.4 Unauthorized Charges
Customers who suspect unauthorized payment activity should promptly contact Behavior Plan Pro and their payment provider.
Nothing in this Policy restricts lawful payment disputes or chargeback rights.
10. MATERIAL SERVICE CHANGES
If Behavior Plan Pro materially reduces or discontinues a core paid feature during an active subscription period, we will provide reasonable notice where practicable.
Where appropriate, we may offer a reasonable alternative, account credit, or prorated refund for affected prepaid services.
Any remedy will be determined in accordance with applicable law, the Terms of Service, and the circumstances of the change.
11. ENTERPRISE AND CUSTOM AGREEMENTS
Organizations purchasing services through a separately negotiated enterprise agreement may be subject to different billing, cancellation, renewal, or refund terms.
Where an executed enterprise agreement expressly conflicts with this Policy, the applicable negotiated provisions will control.
12. CHANGES TO THIS POLICY
Behavior Plan Pro may update this Policy to reflect changes in our services, business operations, or legal obligations.
Material changes will be communicated to affected Customers in advance where appropriate or required by law.
Changes will not retroactively alter completed transactions or eliminate nonwaivable rights.
